TimeClock Plus, LLC (TCP) warrants that all hardware portions of the TCP Services sold by TCP to Client under the terms of the Licensing Agreement will (i) be free from defects in workmanship and (ii) conform to the hardware specifications for a period of twelve (12) months after shipment from DM. If Client, in its reasonable opinion, believes that any hardware or part thereof contains a defect in workmanship, or otherwise fails to conform to the hardware specifications, during the warranty period, TCP shall at its expense correct any such defect by repairing such defective hardware or part or, at TCP’s option, by delivering to Client equivalent hardware or part replacing such defective hardware or part. In the event hardware completely fails to function within the first seventy-two (72) hours of installation (dead-on-arrival or DOA), TCP agrees to replace the failed hardware with new hardware and will use best efforts to ship replacement within four (4) hours of notification using next day delivery.
TCP shall waive any expedite charges to Client in order to affect earliest reasonable replacement of such defective hardware. Notwithstanding the foregoing, if a unit of hardware under warranty should fail owing to a defective component part, TCP shall be responsible to provide reasonable assistance for obtaining a replacement component at no additional charge. If the parties determine a returned product not to be defective or nonconforming, Client will reimburse TCP for any associated costs incurred including but not limited to failure analysis, delivery and expedite charges.
Client may cancel TCP Services or return hardware in original condition within 30 days of purchase with no termination fees. Prepaid TCP Service fees are non-refundable
